Richard Gottlieb is a pioneer in the Canadian trade law field and he has maintained, since 1969 a varied practice covering all international trade issues with emphasis on anti-dumping and subsidy actions, customs valuation, transfer pricing, tariff classification, origin, and export and import controls.
He represents national, multinational corporations, associations, and foreign governments and is extensively involved in strategic trade planning for corporate clients.
He has extensive experience appearing before the Canadian International Trade Tribunal, has sat as a member of panels struck under the dispute resolution mechanism of the NAFTA and has appeared before the Federal Court (Trial and Appellate Divisions) and the Supreme Court of Canada in connection with over 200 anti-dumping and countervailing duty cases, and over 500 customs cases covering virtually every major industry.
He was for decades a frequent speaker in Canada and abroad to business, government and academic organizations, as well as a guest lecturer on anti-dumping and customs at McGill University. He has also written a number of books and articles on trade issues, customs valuation, anti-dumping and countervailing duty cases.
Richard, for many years, has been a member of the Committee on Customs and Trade Regulations of the International Chamber of Commerce ("ICC") and a delegate of the ICC to the World Customs Organization ("WCO") Technical Committee on Customs Valuation.
He has been named among the most frequently recommended customs and international trade lawyers as well as a leader in the fields of trade and customs law in the Canadian Lexpert Directory since 1999, cited in An International Who’s Who of Trade and Customs Lawyers since the inception of this directory in 2001, cited in Chambers Global (The World’s Leading Lawyers for Business) and The Best Lawyers in Canada since 2004. He enjoys an AV® rating of the Bar Register of Preeminent Lawyers of Martindale-Hubbell.
Richard Gottlieb is a frequent participant as speaker and/or moderator at symposia organized by the WCO on customs valuation (royalties, related party transactions and origin). His most recent presentation related to a comparison between transfer pricing (income tax) and transaction value (customs) issues. He was a member of the Technical Advisory Group of the ICC set up to provide input to the WCO on 2007 H.S. modification. Finally, in 2009 Mr. Gottlieb was appointed by the World Trade Organization (“WTO”) as a panelist in connection with a trade dispute between the Philippines and Thailand.
Richard S. Gottlieb holds a B.A. from McGill University and an LL.L. from the University of Montreal. He is a member of the Quebec Bar.
